The best phase of a divorce, if ever we have to pick one, is that time when wounded hearts begin to heal and spouses move on with their respective lives. It is at this phase that divorced wives bloom a second time, and divorced husbands take on an entirely new swagger.

Unfortunately however, it is quite a task to reach this difficult phase. Some of my very own divorced friends even spend six to ten years struggling to move on. They say that one major obstacle in moving forward with their life is the payment of alimony. Who could have the strength to move on if your finances are consistently drained of outrageous alimony dues?

Terminating Support is Not Impossible

If I tell you that the best first step in moving on is to terminate spousal support, you would surely nod your head in disbelief and say that it’s not possible. Well, let me assure you that I am a hundred percent sure on this one. With all the right moves, you could terminate spousal support and live an entirely new, alimony-free life.

Most supporting spouses, usually husbands, are not aware that they could actually reduce or altogether terminate spousal support by simply being aware of the rules in alimony. First off, there’s definitely a case when the supported spouse, usually wives, has demonstrated a lack of effort in becoming self-sufficient. According to Dishon and Block Divorce Attorneys, it’s important to determine two things:

If your spouse was issued a “Gavron Warning” during the trial; and

If your spouse underwent a “vocational assessment.”

If you’ve answered yes to both these points, you definitely have a case.

A Gavron Warning cautions the supported spouse that she must be self-sufficient within a given period of time, and that if she happens to fail doing so, the court may decide to reduce or altogether terminate spousal support. A vocational assessment meanwhile is the assessment of your spouse’s ability for earning; it should reveal how capable she really is in providing for her needs.

Getting the Right Lawyer Matters

While making my research about divorce, particularly in California, I came across a video in YouTube that emphasized how important it is to contract the right lawyer. The man speaking in the video was caught unawares that his wife of thirty years wanted to end the marriage. His divorce trial went so badly for him because his lawyer did not seem to care. When he contracted a lawyer named Erin at Dishon and Block Divorce Attorneys, he was treated with genuine concern. His case was given enough attention, and he managed to terminate spousal support due to his spouse’s cohabitation with her lover. The new partnership with Dishon and Block resulted to the termination of spousal support after the payment of a lump sum, and the speaker emphasized that he was eager and happy to pay for the one-time fee, and then later face an alimony-free life.

I bet that the next success story is your very own divorce tale. You could turn your life around and move on by seeking an opportunity to terminal spousal support. In California, the obligation of alimony is never a lifetime deal. The state considers the income and financial capabilities of both sides, so that with the right lawyer, you will most likely get a fair treatment.

Who’s Next?

We all need somebody to love. Intimacy is an integral aspect in a happy, satisfied life. For divorcees, the most significant development in moving on is finally being able to go dating again. Armed with only the most positive intentions in starting a genuine relationship, it’s time that you should go out there and search for your next romance. It’s only fitting that after you’ve succeeded in terminating spousal support, it’s time to live life to its fullest potential with someone new, and with someone who understands you better than your ex-spouse ever did. It’s time to say, “Who’s Next?” because you deserve every bit of happiness that comes your way.

Most of us do not understand the letter of the law. We know what we think is right and wrong. That can often be very different than what is legal, not legal, and what deserves compensation, and what does not. Only compensation lawyers can assess your situation before a court does. It is certainly worth stopping and thinking about. The next time you are in a car accident and as you go to call your insurance company and the police, here are a few things you should think about. Here are a few points worth considering the next time you are in a bingle.

Health. When we have a car crash we will feel alarmed. Even the smallest car crash in a shopping centre car park will be a shock. When we are shocked our bodies release adrenalin. This is a medical fact, and the common response to any similar situation. Adrenalin makes us aware, and adrenalin gives us strength. You may be hurt and not know it because of Adrenalin. You must always go to a doctor or hospital immediately after an accident, no matter how small, because you possibly do not know you have been hurt. Spinal injuries can take months to surface, and can be caused by, what can appear to be, the smallest of nudges. We must remember, cars are heavy, which means a considerable amount of motion. A small bump can have large ramifications.

Keeping Calm. It will be hard to remember to stay calm when you are excited and driven by Adrenalin. Reading this will help you to remember. Even if you know you are not in complete logical control of your situation, you still will not behave in a similar manner as you normally do. ‘Fight or Flight Response’ by animals and humans alike, has been well documented for some time. Know this, and do your best to remember. Take the advice of those around you. Remember, calling the Police is a must, and getting yourself into the care of professionals is your priority. Hopefully, you will have responsible adults around to help you through the situation. This is not always the case, and remember this now, and this will influence you thoughts if such a situation occurs.

Legal Advice. If we are at work, there will be someone around to help, and someone to advise us to consult workers compensation lawyers. It would be a matter of course. When we are in an incident and in public, and particularly alone, we can often forget what is important. Speed without haste is the essence of the situation. Deal with your legal obligations if possible, and seek a medical examination (if you are lucky enough). Your next step is to seek the advice of an injury or compensation lawyer. Your personal opinion is irrelevant. Consultation is generally free, and in many cases, no win no fee lawyers are there to help.

Lawyers working in this sophisticated area of law can generally assess whether you case will be successful or not. They can do this because they have experience. They would not be able to offer such conditions, if this was not the case. Always stop and think about the future consequences of any unfortunate situation. The ramifications on your lifestyle and health may not appear for some time. Without taking the appropriate measures and steps at the time of the incident, you will have little to stand on. The law is the law.

Domestic violence is an inexcusable action taken by men and women of all ages, races, sizes and attitudes. Unfortunately, it happens far too often. Abuse can be verbal, emotional, or physical. There is no reason to take an argument to the extremes of domestic violence abuse. You may love your husband or wife who is aggressive towards you, but it is not healthy to be in an abusive relationship.

There are ways to get yourself out of your violent situation. While there may be a lot of fear that goes into admitting you’ve been a victim of violence, you are not alone. Turn that fear into strength and renew your life.

If you find yourself in a situation that has gone too far and you want out, there are some steps to take to ensure your safety. You will first want to keep quiet about your plans to leave your partner. Don’t mention it to the children, if there are children involved. You don’t want to scare them. Call for help! Call a local women’s shelter. They will come and quietly pick you and your children up and take you somewhere safe. Somewhere your abusive partner cannot find you. This service is at no expense to you. The volunteers at the women’s shelter will help you plan your future. You might want to have a few things packed up, like you would for a short trip, because you never know when the moment comes that you make that choice to change your life and save yourself and your children from further abuse.

One resource that has a nice amount of information is www. ncadv.com (The National Coalition Against Domestic Violence). Here, you will find what to do if you are still in the abusive and dangerous relationship or if you’ve already left but do not know what to do to keep your former partner away from you. No matter what, they recommend that you document all of the behavior because you may want a restraining order or to possibly press charges one day. They also advise you to be ready to leave at a moment’s notice. Have all paperwork together and handy.

Still in the relationship?

· Find a safe place to go if an argument occurs and avoid rooms with no exits or rooms with weapons

· Have a list of safe contacts and keep it with you

· Establish a code word or sign so family, friends or a co-worker can recognize your need for help

· Call a shelter when you cannot take it anymore

If you’ve left…

· Change your phone number and screen your calls

· Save and document all contact with abusive partner

· Avoid being alone

· Meet in public if you need to meet at all

· Vary your routine

· Call shelter or support groups

Take your life into your own hands and not someone else’s hands. It might be difficult for you to begin the process but it is not a difficult process once you get started. You are not alone.

It is estimated that only about 17 percent of eligible spouses are actually receiving VA benefits. Surely the reason cannot be because individuals don’t need or want the additional income so it has to be because they either don’t know they qualify or the application process is to confusing and intimidating. VA benefits are often thought to be exclusively for the veteran but the costs for a spouses’ medical care can be covered because this often causes a great deal of financial hardship as well. Alternatively, spouses can apply to receive their husband’s (or wives) benefits even after the event of their death.

Are You Eligible?

If you are a spouse asking, “Do I qualify for VA benefits?”, you must first understand that it is your last marriage that will make you eligible. Therefore, if you have remarried, there is a good chance that you no longer qualify. Also, the marriage to the veteran must have lasted for a minimum of one year and divorces void any eligibility. However, if you are separated, you may still apply. You are required to be able to report your spouse’s service dates as well as their military history.

Also, you are not permitted to have more than $50,000 in assets but the home where you reside and social security income do not count. You also need to be able to prove that you are legally blind or close to blind, reside in a nursing home or require assistance performing daily duties such as cooking, bathing, getting dressed, etc.

Verifying Eligibility

You need to be aware that just because you qualify for your spouse’s VA benefits, does not mean that you are guaranteed to receive them permanently. You will have to fill out an Eligibility Verification Report every year so that the VA can evaluate your current situation. Considerations will be of any changes in assets, income or your medical condition.

Since there are so many details involved, it is always recommended to work with an attorney who specializes in VA benefits. The last thing you need is to become disqualified or required to pay back benefits because of an error in your paperwork. Not to mention, a qualified attorney can often get you your benefits in three months rather than the typical three year waiting period. Also, they can review everything ahead of time to make you that you are approved with your first application.

About the Author

A car accident is an all too common part of everyday life. If you’ve been in an car accident that isn’t your fault protecting your rights from the scene of the crash onward is one of the most important things that you can do. The burden will be on you to prove that your injuries or the property damage that you suffered were the result of someone else’s negligence. Luckily there are several different easy to follow tips that will help you protect your rights in any circumstance.

The most important thing you can do if you are involved in a car crash that is someone else’s fault is to call the police and have them file a report. Having a police report on file with the testimony of the officer and both parties involved will make sure that you have your story written down by an authority figure when it is freshest in your mind. The officer will also usually apply guilt in the case write the appropriate citations, and this will go on official records as well and can be used as evidence of someone else’s negligence. It will also serve as official testimony that you can use during any insurance settlement negotiations or in a trial if you should so happen to have to take your case that far. Your second call should be to a car accident attorney.

Your only hope of collecting any money if you are the crash victim and submit a car accident claim is if you have car accident insurance. The odds are the driver of the other car does not have the cash to compensate you. This is why it is so important for you to have the proper protection. A car accident insurance claim is your only hope of being compensated.

Next, after the accident scene is cleaned up, make sure that you make a visit to the hospital or a doctor’s office as soon as possible if you think you have suffered any injuries as a result of the accident. By going to seek professional help right away you will have an official record of the injuries that took place during the crash and there will be the least amount of doubt cast on your claims. Even in a minor crash a car accident injury can take place and be severe.

Finally, if your case warrants it, the biggest and easiest way to protect your rights as a car accident victim is to hire a car accident injury lawyer. Lawyers are professionals and deal with insurance companies and car accident claims day in and day out so they are familiar with how they work. They are also very well aware of what car accident settlements are all about and the amount you are entitled to and will fight to get that settlement through negotiations or in the courtroom. If your auto accident settlement involves substantial sums of money, having a car accident attorney isn’t a luxury, it’s a necessity.
